Additional Terms of Sale

Transfer of Title: Title to products passes from the International Humic Substances Society (IHSS) to the Customer on shipment from the IHSS office in St. Paul MN, USA. IHSS is not responsible for import duties and taxes. No sales tax is charged, except for shipment to customers in the state of Minnesota, USA.

Shipping Charges and Risk of Loss. Shipping and handling are additional to the cost of the products. For products shipped to destinations in the United States loss or damage that occurs during shipment is the responsibility of IHSS. In the case of shipment to other countries the risk of loss or damage passes to the Customer upon (1) the release of the products from the custody of the carrier at the Port of Entry designated by the buyer or (2) the entry of the products into any custom clearance area or facility at such Port of Entry, whichever first occurs.

Return of damaged or defective products. Damaged or defective items may be returned for replacement at no charge. IHSS does not accept returns for other reasons. Claims for replacement will be honored if the request is received within 120 days of the order date.

Import Duties and Taxes. The recipient of the shipment is the importer of record in the destination country and is responsible for all Import Fees and other taxes. Our products are not subject to customs duties in the European Union (EU) and most non EU countries. The harmonized international code (Schedule B) for humic products is 3822000002 (laboratory reagents).

Sales Taxes. Products shipped to customers in the State of Minnesota, USA, are subject to Sales Tax unless you provide IHSS with a valid and correct tax exemption certificate applicable to your purchase.

Soil pathogen import restrictions. HA, FA and NOM have been sufficiently processed to be not problematic. Upon request, we can supply a description of the processes used, describing how our processing mitigates against pathogens. Customers are responsible for pathology restrictions that might apply to import of bulk Pahokee peat or Elliott soil. These materials have not been treated to eliminate pathogens. The bulk Leonardite is a geologic material from a coal seam and is not generally subject to pathogen import restrictions.
